Maker Agreement
The terms for submitting films to FlickFuel — the rights you keep, the licence you grant, how winners are chosen, and how Production Grants work.
The short version. You keep every right in your film. You give us permission to show it. Entering the Festival is free and always will be — a Maker subscription buys tools, never entry. Production Grants are prizes we pay out of our own revenue, decided by a jury on merit. Nobody buys a win.
1. This agreement
This Maker Agreement is between you and Indrevo, a business name of Blackhold Group Pty Ltd (ACN 702 584 790), of Suite 17, 89–97 Jones Street, Ultimo NSW 2007, Australia. It applies from the moment you submit a film to FlickFuel and sits alongside the Terms of Service, the Privacy Policy and the Community Guidelines. Where it conflicts with the Terms on a matter it covers, this agreement governs.
You must be at least 18 years old to submit a film.
2. You keep your film
You own your film. Nothing here transfers copyright, moral rights or any other right in it to us. What you give us is permission to run the Service.
You grant Indrevo a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, encode, transcode, reproduce, adapt for streaming, publicly perform and publicly display your film and its associated material (title, logline, synopsis, poster, still frames, credits and declared tools) for the purposes of:
- operating the Service — showing the film in the deck, the player, Premieres, the Jury Board and the Hall of Fame;
- moderation, safety, copyright enforcement and dispute resolution;
- promoting FlickFuel — using short extracts, stills and the poster in marketing, trailers, social posts, press material and store listings, with your name credited.
The licence lasts while your film is on the Service. If you remove the film or delete your account, the licence ends for new uses within 30 days, except that: promotional material already published may remain in circulation; a film that took part in a closed Festival may be retained in anonymised form for up to 30 days so that Festival’s record stays consistent; a Hall of Fame entry recording a win may be kept permanently; and we keep what the law requires us to keep.
You may licence, sell, distribute, screen or enter your film anywhere else at any time. FlickFuel takes no exclusivity of any kind.
3. What you promise us
Each time you submit a film you confirm that:
- you created it, and you hold or control every right needed to grant the licence in section 2;
- it does not infringe anyone’s copyright, trademark, moral rights, privacy, publicity or other rights;
- you have cleared every element you did not create yourself — music, footage, images, voices and likenesses;
- every real, identifiable person in it has consented, except where section 4 of the Guidelines permits otherwise;
- you have accurately declared the AI tools used;
- it complies with the Community Guidelines and with the law where you are and where it will be seen;
- it is not subject to any claim, dispute or encumbrance that would prevent us showing it.
You indemnify Indrevo against loss, damage, cost and reasonable legal expense arising from a breach of these promises, capped, except in the case of your fraud or wilful infringement, at the greater of AU$5,000 and the total amount we have paid you.
4. Entry is free
No payment of any kind is required to enter a Festival, to be eligible for an award, or to receive a Production Grant. Every Maker with a qualifying film enters on the same footing, whether they pay us anything or not.
Maker Indie and Maker Studio subscriptions buy production capacity — storage, resolution, runtime headroom, serials, custom posters and analytics. They do not buy entry, eligibility, ranking, shortlist position, jury attention, or any advantage in any award. A subscriber and a free Maker with equal films have an equal chance.
5. Eligibility
- Runtime of at least 3:00. A film under three minutes is a Trailer, and a Trailer may only be attached to an eligible film.
- Published at least 72 hours before the Festival closes.
- Cleared moderation and publicly visible.
- No live copyright strike against you.
- One primary category, chosen at upload and locked on publication.
- You are 18 or over, and identity-verified before any grant is paid.
6. How winners are decided
The Festival is a competition of skill. Outcomes turn on the merit of the work. There is no element of chance, and no entry fee.
- Audience shortlist. Earned Fuel and pass rates produce a ranked shortlist in each category. Only earned Fuel counts. Purchased Fuel buys visibility, extra watches and tips, and has no effect on ranking, shortlist or award.
- Jury. A jury appointed by us selects Gold, Silver and Bronze in each category, and Best Picture, Best Debut and Audience Choice, from the shortlist, against published criteria: storytelling (does it work as a story), craft (direction, pacing, sound, edit), originality (is it its own thing), and use of the medium (does it do something the tools make newly possible).
- Review. Ties, anomalies and suspected manipulation go to a review queue for up to 48 hours before an award is confirmed.
- Decision. The jury’s decision determines the winners and is final. Criteria and the jury’s composition are published before each Festival opens.
Where the law of your country imposes an additional condition, it applies. Canadian entrants must correctly answer a time-limited mathematical skill-testing question before an award is released. Awards are void where prohibited by law, and are subject to any permit or authorisation conditions in your jurisdiction.
7. Production Grants
A Production Grant is a discretionary prize paid by Indrevo out of its own revenue to fund a winning Maker’s next film.
A Grant is not a share of revenue, a commission, a royalty, a distribution, a return on any user’s purchase, or a payment made on behalf of one user to another. No purchase by any user creates an entitlement in any Maker. We size the pool and publish the split before each Festival; the formula is ours and may change between Festivals on notice.
Conditions of payment. A Grant is released only when you have completed identity and tax verification with our payments provider, you hold no live copyright strike, your winning film has cleared review, and any country-specific condition has been met. We may withhold or reverse a Grant where we reasonably believe the result was manipulated or the entry breached this agreement.
Payment. Grants are paid through Stripe Connect and are arranged on the web, never inside the app. Payments are made in the currency your account supports, and any transfer or conversion fee charged by the payment provider or your bank is yours. A Grant not claimed within 12 months of being awarded lapses.
Tax. A Grant is income to you. You are responsible for your own tax, including GST or VAT registration if it applies to you. We report and withhold where the law requires. If you are an Australian business, give us your ABN — without it we may be required to withhold tax at the top rate.
No promise. We make no representation that you will win anything, earn anything, or reach any particular audience. Nothing here is an offer of employment, partnership, agency or joint venture. You are an independent creator.
8. Tips and boosts
Viewers may spend purchased Fuel to tip you or to boost your film’s visibility. Tips are recorded against your account and are paid out on the same terms and conditions as Grants. A boost buys placement in the deck — it never changes ranking, shortlist position or any award outcome, and the film card shows that a boost is running.
9. Removal, strikes and appeals
We may remove a film, disqualify an entry or restrict your account where this agreement, the Guidelines or the law requires it. Copyright strikes run on the three-strike scale in the Guidelines. We will tell you what we did and why, and you may appeal to admin@flickfuel.online; we aim to answer within 14 days. 10. Ending this agreement
You may remove your films or delete your account at any time. Doing so forfeits eligibility in any Festival still open, and does not affect a Grant already awarded and payable. We may end this agreement for breach, where the law requires, or if we discontinue the Service — in which case we will honour any Grant already awarded.
Sections 2 (to the extent stated), 3, 7 (tax and no-promise), 11 and 12 survive termination.
11. Liability
To the extent the law allows, our total liability to you under this agreement in any 12-month period is limited to the greater of AU$500 and the total Grants and tips we paid you in that period. Nothing here excludes, restricts or modifies a guarantee, right or remedy under the Australian Consumer Law or the equivalent non-excludable law where you live.
12. Law, and changes
This agreement is governed by the law of New South Wales, Australia, with the non-exclusive jurisdiction of its courts; if you are a consumer elsewhere, your local mandatory protections still apply. We may update this agreement, and where a change is material we will give 14 days’ notice in the app or by email. A change never alters the terms of a Grant already awarded, or of a Festival already open.
